There are three types of EB-1 Visa
EB-1A Extraordinary Ability Individuals
The EB-1A visa is a subcategory of the EB-1 extraordinary ability visa, intended for individuals who possess exceptional abilities in the sciences, arts, education, and athletics.
This category is designed for the few individuals who have attained the highest level of achievement in their respective fields or have received recognition on a national or international level.
EB-1B Outstanding Professor or Researcher
The EB-1B visa is a subcategory of the EB-1 extraordinary ability green card. This subcategory is designed for professors and researchers who have gained international recognition in their respective fields. In order to qualify, the applicant must have at least 3 years of experience in teaching or conducting research in their academic area.
The EB-1B does not mandate a PERM labor certification. However, applicants must be sponsored by an employer and must provide evidence that they are pursuing either a tenured position or a research position of a comparable position.
EB-1C Multinational Manager
The EB-1C visa is an immigrant visa that is often used by multinational executives, managers to go from an overseas parent company or subsidiary to the U.S. company. In order to qualify for the EB-1C visa, there are several requirements:There must be a Qualifying Relationship between the U.S. company and the Foreign one; The U.S. company must have been in operation for at least 1 year; The foreign executives job duties must be managerial or executive in nature.
What are benefits of an EB-1A Visa?
One of the most notable advantages of the EB1-A Visa is the expedited processing time.
Other types of green cards not only need a company to go through the PERM procedure, but they likewise have backlogs that can considerably increase the wait time.




The EB1A visa does not require a US company sponsor.




There is no requirement for investment or duration of stay in the US after application.




The applicant can bring eligible dependants to the US, including the spouse and the children under the age of 21.
How long does it take to get the EB-1A visa approved?

(Please notice that: Starting from 2023, EB1A will be scheduled and slowed down. )


There are two types of EB-1A green card applications: those filed in the United States and those filed outside the United States.


· Adjustment of Status


If the EB-1A petitioner is in the U.S. and is converting from another visa status (e.g., H1b, O1, L1, etc.) to green card status, the petition will need to be filed on Form I-140 and Form I-485. The results of the I-140 phase of the petition may be expedited and will be known within 30 days, while the 485 phase of the petition can result in a green card in 10-20 months. Total estimated time: 24 months.


·  Consular Processing


If the EB-1A petition is filed outside the U.S., the petition needs to be filed on Form I-140 and Form DS-260. Same as above, at the Form I-140 stage, you can choose to expedite the processing, and the result will be known within 30 days. 140 approval needs to apply for an interview at the embassy. The waiting time for an interview is about 6-12 months.
